On your day…

Today is just like any other Thursday. Subtle, breezy and very idle for many. To many us, this is not a day to go out for many obvious reasons. Work, school and “color coding”. But whatever the reasons may be, no one can stop making this day special for my wife. It’s her birthday.

I cannot help but make this prose to show and speak, at least in my own way, how I wanted to be with her all the time. How I wanted to talk to her all of the time. How I wanted to cherish each and every moment with her as if we are literally as we feel – inseparable. But the rules of the society and the dictates of culture tell us that we need to work. We need to sacrifice our time and be apart in order that we could be together longer.

Without any words, I feel how she wanted me to turn back the time when we were not so preoccupied. I wanted too. But the fruit of love, i.e. our children, and their needs, suggest we might have to render some degree of sacrifice, and work even longer and harder, so that we live in a comfortable setup. We have to plan and invest in a more stable and lasting profession than we have. As long as we are not so stable, we cannot just sit and relax. God knows, how I wanted to bring those years back. Maybe not now. But I am working so hard to get it in the near future.

Today is to forget all of those above and seize the day. For without my wife in her personality, I cannot be anybody myself, neither our children. While my wife gives her thanks to the Lord for another year of healthy life, we, RJ and Jacob, thank Thee also, that we are blessed of having her in our lives. We can never ask for more.

Ang BAC Secretariat (BAC-S) – Part 2 of 2

Ang komposisyon ng BAC Secretariat ay itinatalaga ng HOPE ayon sa diskusyon noong nakaraang lingo. Ibig sabihin, tulad ng BAC, ang Secretariat ay may hiwalay na tungkulin at pananagutan para sa kanilang limitadong kapangyarihan kahit pa sila ay nakatakdang gumanap sa mga pagsasakatuparan ng BAC.

14.2. The head of the Secretariat in central offices shall be at least a fifth ranking permanent employee or, if not available, a permanent official of the next lower rank; or shall be at least a third ranking permanent employee in bureaus, regional offices and sub-regional/ district offices, or if not available, a permanent employee of the next lower rank. In addition to integrity, heads of Procuring Entities shall consider procurement proficiency as a factor in designating the head of the Secretariat and Procurement Unit.

Tulad ng kwalipikasyon ng BAC, ang Head ng Secretariat ay marapat na mapagkakatiwalaan at may reputasyon at integridad na walang bahid ng corruption. Bukod sa katangiang ito, dapat isaalangalang ang sapat na kaalaman at kahusayan sa pagganap ng tungulin sa pagpapatupad ng procurement activities ang sinumang itatalaga dito.

14.3. To expedite the procurement process, the Head of the Procuring Entity shall ensure that the members of the BAC and TWG shall give utmost priority to BAC assignments over all other duties and responsibilities, until the requirements for the said assignments at hand are completed.

Bihirang mapagtuunan ang seksyong ito ng IRR. Marami kasi ang sumisilip at minsa’y naiinggit sa pagtutok ng BAC sa kanilang tungkulin na minsa’y higit sa kanilang orihinal na trabaho. Ang katotohanan: higit pa sa sapat na atensyon ang kailangan. Nauuunawaan ng batas na kailangan ito sa mga kritikal na transaksyon na may kinalaman sa BAC. Ito ay ipinaalala sa mga Mayor (HOPE) ng bawat bayan o lungsod. Kung mas napapadalas ang pagtupad ng BAC, Secretariat at TWG sa atas ng tungkulin, sa bidding at sa pagsasaayos ng papel nito, ito ay naayon lamang sa jury duty na itinakda ng batas na minsan na nating nabanggit sa nakaraang diskusyon.

Ang usapan na “tamBAC” ang trabaho sa BAC ay totoo. Hindi biro ang mabigayan ng katungkulang at dapat isang karangalan ang maging bahagi nito. Maliban na maranasan ng indibidwal na maging kasapi at masubaybayan ang probisyon ng RA.9184 sa pagtupad ng tungkulin, iisipin lamang ng karamihan na katanyagan lang dala ng maging kasapi nito. Sa iba, maaring isipin na extra income lang ito dahil sa honoraria na natatanggap ng mga kasapi. Maraming pwedeng impresyon. Subalit ang masakit dito, higit na nakakarami ang nag-iisip na bumabaha ang “biyaya” sa mga kasapi ng BAC, Secretariat at TWG kahit taliwas sa katotohanan. Kaya nga, laging dalawa ang mukha ng pagiging miyembro ng BAC – ang serbisyo na may dedikasyon at pagsasamantala sa pwesto. Subalit kung susundin lamang natin ang dalawang pangunahing kwalipikasyon sa pagtanggap ng kasapi:

UNQUESTIONABLE INTEGRITY and PROCUREMENT PROFICIENCY                                                           

Hindi lalatay o hahaplit man lang ang corruption kung masusunod lamang ang mga katangiang ito. Ang trabaho sa Secretariat ay isa sa pinakamabusising bahagi ng procurement. Dapat ay parehas kang nagtataglay ng bahagi ng katauhan ng maging isang BAC at TWG. Bahagi ng kaalaman ng BAC para sa kahandaan sa mga resolusyon at rekomendasyon sa mga pagdinig at bahagi ng kaalaman ng TWG para makita agad ang kakulangan o katumpakan sa mga dokumentong isinusumite o tinatanggap. Sa anumang sitwasyon, mananatili pa rin ang Secretariat na central channel o pangunahing tagapagsalita at tagapakinig ng lahat ng ahensya o grupo na may pangangailangan sa isa’t isa.

Ano ang Technical Working Group o TWG? Iyan naman ang ating pag-uusapan sa susunod na isyu.

Q: Is there a violation on choosing an OIC Accountant as BAC Secretary?[firstlady_5167]

A: I believe No. Although, there is no direct prohibition under R.A. 9184 and its IRR, Chief Accountants are discouraged from being BAC members to prevent any conflict of interest as contained in COA Circular 2003-004, dated July 2003. However if such OIC accountant has a supervisory functions only, then he/she can be a BAC member. IF NO CONFLICT OF INTEREST MAY ARISE FROM SUCH APPOINTMENT he/she can be a BAC Sec or member. Ang BAC Secretariat (BAC-S) – Part 1 of 2

Alam na natin na ang BAC ang nagtataglay ng halos lahat ng tungkulin at responsibilidad sa pagpapatupad ng mga probisyon ng RA.9184. Lingid sa ilan, may isang grupo na gumagawa ng karamihan sa administrative at clerical works para mapangyari ang mga desisyon ng BAC. Ito ang BAC Secretariat. Ayon sa Sec.14 ng Revised IRR:

14.1. The Head of the Procuring Entity shall create a Secretariat which will serve as the main support unit of the BAC. An existing organic office within the procuring entity may also be designated to serve as Secretariat. However, to strengthen and promote the professionalization of the organizations’ procuring unit, the Head of the Procuring Entity may create procurement units that may serve concurrently as BAC Secretariat in accordance with the guidelines issued by DBM. The Secretariat shall have the following functions and responsibilities:

a) Provide administrative support to the BAC;

b) Organize and make all necessary arrangements for BAC meetings and conferences;

c) Prepare minutes of meetings and resolutions of the BAC;

d) Take custody of procurement documents and other records;

e) Manage the sale and distribution of Bidding Documents to interested bidders;

f) Advertise and/or post bidding opportunities, including Bidding Documents, and notices of awards;

g) Assist in managing the procurement processes;

h) Monitor procurement activities and milestones for proper reporting to relevant agencies when required;

i) Consolidate PPMPs from various units of the procuring entity to make them available for review as indicated in Section 7 of this IRR; and

j) Act as the central channel of communications for the BAC with end users, PMOs, other units of the line agency, other government agencies, providers of goods, infrastructure projects, and consulting services, observers, and the general public.

Kung ang military ay may 10-General Orders, ito naman ang katumbas sa BAC Secretariat. Sa madaling salita, ang BAC Secretariat ang “kamay” at “paa” na kumikilos sa anuman patakaran at alituntunin ng BAC. Ito ang grupong gumaganap na maging kalihim. Kung may opisina ang BAC, sila ang una at huling haharap sa mga biddersa pagsali at pagrekomenda ng kontrata sa HOPE.

Q: We have a contractual & casual employees designated as BAC Secretariat by the Head of our Procuring Entity due to lack of manpower in our agency. Regular employees are having multi-tasking functions already, that is why the Head of the Procuring Entity designated them. Is it allowed in the RA 9184?[joy_ONP]

A: The Head of the BAC Secretariat should be a permanent employee, but the members, due to “lack of manpower” could be contractuals. One of the intent of the GPRA is the professionalization of the BAC, TWG, BAC Sec, and Procurement Units, and one way to achieve it is to designate permanent (plantilla) positions which would compose those procurement organizations [RDV].

Bids and Awards Committee (BAC) – Part 4 of 4

Sabayan nating buuin ang diskusyon sa komposisyon at tungkulin ng Bids and Awards Committee o BAC:

12.1. The BAC shall have the following functions: (a) advertise and/or post the invitation to bid/request for expressions of interest; (b) conduct pre-procurement and pre-bid conferences; (c) determine the eligibility of prospective bidders; (d) receive bids; (e) conduct the evaluation of bids; (f) undertake post-qualification proceedings; (g) resolve motions for reconsideration; (h) recommend award of contracts to the Head of the Procuring Entity or his duly authorized representative: (i) recommend the imposition of sanctions in accordance with Rule XXIII; (j) recommend to the Head of the Procuring Entity the use of Alternative Methods of Procurement as provided for in Rule XVI hereof; and (k) perform such other related functions as may be necessary, including the creation of a Technical Working Group (TWG) from a pool of technical, financial, and/or legal experts to assist in the procurement process, particularly in the eligibility screening, evaluation of bids, and post-qualification.

Malinaw at komprehensibo ang gampanin ng BAC – mula sa pag-aanunsyo ng procurement.hanggang sa pagrekomenda sa pagwawagi ng kontrata matapos ang itinakdang bidding o procurement procedures. Responsable din ang BAC sa sensitibong pagsusuri ng lahat ng dokumento dahil sila ang may pananagutan sa pagtanggap o pagtanggi dito. Ang pagtatalaga ng Technical Working Group o TWG mula sa mga eksperto sa legal, teknikal, at pinansyal na aspeto ng procurement ay isang alternatibo na pwedeng italaga ng BAC kung sakaling hindi sapat ang kakayahan at kaalaman nila sa bahagi ng  evaluation kung saan ito kailangan.

12.2. The BAC shall be responsible for ensuring that the procuring entity abides by the standards set forth by the Act and this IRR, and it shall prepare a procurement monitoring report in the form prescribed by the GPPB. The procurement monitoring report shall cover all procurement activities specified in the APP, whether ongoing and completed, from the holding of the pre-procurement conference to the issuance of notice of award and the approval of the contract, including the standard and actual time for each major procurement activity. The procurement monitoring report shall be approved and submitted by the Head of the Procuring Entity to the GPPB in printed and electronic format within fourteen (14) calendar days after the end of each semester.

Ang pagsisiguro na lahat ng probisyon ng RA.9184 ay masusunod ay pananagutan ng BAC. Ang paggawa ng Procurement Monitoring Report o PMR ay responsibilidad ng BAC samantalang ang pagsumite sa deadline na nabanggit sa GPPB ay nakaatang sa HOPE.

Q:  When does the task of the BAC for a particular project end? Is it after the issuance by the head of the procuring entity of the Notice to Proceed? Who will then request for repeat order and the extension of the contract? (No.7 NPM 083-2007)

A: All members of the BAC shall be on a “jury duty” type of assignment until a Notice of Award is issued by the head of the procuring entity in order to complete the entire procurement process at the earliest possible time.

Whenever justified by the conditions provided … the BAC shall recommend to the head of the procuring entity the use of repeat order. After the head of the procuring entity approves the recommendation of the BAC, the latter through its Secretariat shall confirm the repeat order with the previous supplier. The end-user unit shall prepare the contract or purchase order.

Bids and Awards Committee (BAC) – Part 3 of 4

Bago natin tuluyang pag-usapan ang tungkulin at responsibilidad ng BAC, tunghayan muna natin ang kahulugan ng quorum:

12.3. Quorum

A majority of the total BAC composition as designated by the Head of the Procuring Entity shall constitute a quorum for the transaction of business, provided that the presence of the Chairman or Vice-Chairman shall be required.

Sa madaling salita, nag-uumpisa ang isang legal na transaksyon at desisyon ng BAC sa quorum o ang pinakakaunting bilang ng mga miyembrong uupo sa isang meeting. Kung mayroong limang kasapi ang BAC halimbawa, tatlo ang huhusto sa quorum. Bukod sa bilang, kinakailangang narororoon din at kasama sa bilang ang Chairman o kahit ang Vice Chairman man lamang.

12.4. Meetings

The Chairman or, in his absence, the Vice-Chairman, shall preside at all meetings of the BAC. The decision of at least a majority of those present at a meeting at which there is quorum shall be valid and binding as an act of the BAC: Provided, however, That the Chairman or, in his absence, the Vice-Chairman, shall vote only in case of a tie.

Pangunahing tunkulin ng BAC Chairman ang pangunguna sa sesyon at at maging punong tagapagsalita sa kabuuan ng meeting. Ito naman ay gagampanan ng Vice Chairman kung wala ang Chairman. Ukol naman sa pagdedesisyon, ang gumaganap na punong tagapagsalita ay boboto lamang kung pantay o tabla ang boto ng mga “payag” at “hindi”.

First, the designation of alternate BAC members is just an option that an LGU may do. It is not mandatory on the part of the HOPE to designate alternate BAC members. The designation of alternate BAC members is to address mainly the problem of getting a quorum. 

Second, if ever the HOPE designates alternate BAC members, there should be a one-to-one correspondence between the alternate BAC member and their respective principals. In other words, an alternate BAC member could only alternate for his/her principal and nobody else.

Third, since the regular BAC members (in the case of LGUs) elect among themselves who will be their BAC Chair and Vice-Chair, the alternates of the BAC Chair and the Vice-Chair may also be the alternate BAC Chair and alternate Vice-Chair. In the case of NGAs/GOCCs, the HOPE may directly designate the alternate BAC Chair and alternate Vice Chair.

Fourth, in case the BAC Chair is absent, between the Vice Chair and the alternate BAC Chair, the latter shall take precedence. Hence, the alternate BAC Chair shall preside, instead of the Vice Chair. The alternate BAC Chair should have the same qualifications (at least 3rd ranking) since the revised IRR requires that the alternates have the same qualifications as their principals.

Fifth, there could be other options that the LGU-BACs may adopt. They can come up with their own rules such as the Vice Chair presiding the meeting if the BAC Chair is not around. It should be clear in the rules to avoid any problems in the future.

Bids and Awards Committee (BAC) – Part 2 of 4

Isa sa mga bagong probisyon ng Revised IRR ang pagtatalaga ng kahalili o alternate members. Ayon sa Sec.11.2.4:

Sec.11.2.4.The Head of the Procuring Entity may designate alternate members to the BAC, who shall have the same qualifications as their principals as set in the Act and this IRR. The alternate members shall attend meetings of the BAC and receive the corresponding honoraria, whenever their principals are absent. The alternate members shall have the same term as their principals. The accountability of the principal and the alternate member shall be limited to their respective acts and decisions.

Sa nakaraang IRR, tahimik ang batas tungkol dito. Dati, pinapayagan ang kahalili subalit wala silang karapatang bumoto, pumirma at makisali sa collegial decisions ng BAC. Kailangan lang ay kwalipikado at may katumbas na posisyon tulad ng sa kanilang hahalinhan.

Sec.11.2.5 In no case shall the Head of the Procuring Entity and/or the approving authority be the Chairman or a member of the BAC.

Ito ang pangunahing pagbabawal sa pagiging kasapi ng BAC. Sinuman na may kapasidad at inatasan ng batas na maging HOPE ay hindi pinapayagang sumali sa desisyon at pagsusuri ng BAC. Ito ang malaking kaibahan ng naunang bersyon ng BAC (na PBAC ang tawag noong araw) kung saan ang nag-aaprubang opisyal (mga Gobernador at Mayor sa pamahalaan lokal) ay kasali sa proceedings ng public bidding.

Sec.11.2.6 Unless sooner removed for a cause, the members of the BAC shall have a fixed term of one (1) year reckoned from the date of appointment, renewable at the discretion of the Head of the Procuring Entity. Upon expiration of the terms of the current members, they shall continue to exercise their functions until new BAC members are designated. In case of resignation, retirement, separation, transfer, re-assignment, removal, or death, the replacement shall serve only for the unexpired term: Provided, however, that in case of leave or suspension, the replacement shall serve only for the duration of the leave or suspension. For justifiable causes, a member shall be suspended or removed by the Head of the Procuring Entity.

Ang mga kasapi ng BAC ay may isang taong termino mula sa pagkakaluklok sa pwesto. Maari silang panatilihin o palitan depende sa diskresyon ng HOPE (Gobernador, Mayor, Barangay Chairman). Sakaling walang renewal o bagong appointment matapos ang isang taon, mananatili ang mga kasapi ng BAC hanggang maglabas ng bagong panukala sa mga mananatili at papalitang kasapi ng BAC. Sakali namang mawala ang isang miyembro sa anumang makatarungang dahilan, maaari silang halinhan ng bagong kasapi. Ipaglilingkod ng humalili ang nalalabing termino ng kaniyang hinalinhan.

Q:[engrjhez] If there exists “alternate-BAC members” as designated by the HOPE (consider an LGU case), does it follow that if their principals are either Chair or Vice Chair, they inherit the same assignment?  If a BAC member is not present, his or her alternate member may be placed in substitute. Suppose we have a case where there are five (5) BAC members and five (5) BAC alternates (they are 10 all in all, right?). In a very unique scenario, three (3) BAC members (provided that not both of the chair and vice chair are together) with their alternates are not available to attend the procurement proceedings. Can an alternate of a “present” BAC member be placed in substitute of those who are absent for the purposes of quorum?

A:[RDV] I am of the impression that when that new provision was proposed the discussion was focused to the situations of NGAs and GOCCs, and not of the LGUs. There might be an oversight on the part of those who framed the revised IRR that there is already a different way of determining who the BAC Chair and BAC Vice Chair will be. Unlike in the case of NGAs/GOCCs/GFIs in which the BAC Chair and Vice Chair are directly designated by the HOPE, in the case of LGUs, they are elected by the BAC members among themselves.

Bids and Awards Committee (BAC) – Part 1 of 4

Tunghayan naman natin ang pagsusuri sa komposisyon ng BAC o Bids and Awards Committee. Sabi sa Sec.11.2 ng Revised IRR:

11.2.1. The Head of the Procuring Entity shall designate at least five (5) but not more than seven (7) members to the BAC of unquestionable integrity and procurement proficiency.

Sino naman ang Head of Procuring Entity o HOPE? Ayon sa Sec.5(t):

Head of the Procuring Entity. Refers to: (i) the head of the agency or body, or his duly authorized official, for NGAs and the constitutional commissions or offices, and branches of government; (ii) the governing board or its duly authorized official, for GOCCs, GFIs and SUCs; or (iii) the local chief executive, for LGUs: Provided, however, That in an agency, department, or office where the procurement is decentralized, the head of each decentralized unit shall be considered as the Head of the Procuring Entity, subject to the limitations and authority delegated by the head of the agency, department, or office.

Sa pamahalaang lokal o LGU, ang HOPE ay tumutukoy sa:

  1. Gobernador – para sa mga probinsya;
  2. Mayor – para sa bayan at lunsod; at
  3. Barangay Chairman o Punong Barangay – para sa mga barangay

Samakatwid, ang HOPE ng isang ahensya ng pamahalaan ang magluluklok sa mga magiging miyembro ng BAC. Kung sino-sino ang pwede sa LGU na mapa-pwesto sa BAC, tingnan natin sa Sec.11.2.3:

The BAC for Local Government Units shall be composed of the following:

a)      One representative each from the regular offices under the Office of the Local Chief Executive such as, but not limited to, the following: Office of the Administrator, Budget Office, Legal Office, Engineering Office, General Services Offices; and

b)      A representative from the end user unit.

The members shall elect among themselves who shall act as the Chairman and Vice Chairman. The Chairman of the BAC shall be at least a third ranking permanent official of the procuring entity. The members of the BAC shall be personnel occupying plantilla positions of the procuring entity concerned.

Tanong: Ang isa bang ordinaryong kawani ng gobyerno na nasa plantilya at kabilang sa mga opisinang nabanggit ay maaaring umupo sa BAC?

Sagot:

Opo. Walang sinasabi ang batas na pwesto o katungkulan ng kawani na maaaring maging BAC member. Kung may appointment ang isang kawani mula sa HOPE, maaari syang magsilbi bilang BAC member. Kaya lamang, hindi siya maaaring maupo bilang Chairman dahil may kaukulang ranking o posisyon ang maaari laman maging Chairman. Kailangan ay katumbas ng pangatlo sa pinakamatatas na posisyon ng ahensya. Sa pamahalaang bayan halimbawa, ang Mayor ang first ranking, kasunod ng Vice mayor bilang second ranking, at department heads bilang third ranking.  Maliban sa Chairman o katumbas na kahalili niya (pag-uusapan sa susunod na mga isyu), ang permanenteng posisyon ay sapat na upang maging kwalipikado sa BAC.
